By using our services, you agree to abide by these rules and guidelines, which outline your rights.
This document is an electronic record under the Information Technology Act, 2000 and applicable rules (including the Intermediaries Guidelines & Digital Media Ethics Code Rules, 2021). It is published in accordance with Rule 3(1) to provide the rules, regulations, Privacy Policy, and Terms of Use for access to the Pick My Chef website.
These Terms form a legally binding agreement between Pick My Chef Private Limited (“Pick My Chef”, “Company”, “we”, “us”, “our”), operated by RAIQA AI INDIA PRIVATE LIMITED, and the user (“you”, “User”) governing your access to and use of www.pickmychef.com (the “Website”).
By accessing or using the Website, you agree to these Terms, our Privacy Policy, and our Cancellation & Refund Policy. If you do not agree, please do not use the Website.
1) Scope of Services & Role as Intermediary
What we do: Pick My Chef is a curated marketplace connecting home chefs (“Chefs”) with customers for ordering freshly prepared meals and subscriptions(“Services”).
Intermediary: We act only as an online intermediary facilitating discovery, ordering, payments, and logistics coordination. We do not manufacture, cook, or sell food; Chefs supply food independently.
Drop -off: Orders may be dropped-off by our in-house team and/or third-party partners (“Partners”), who are independent contractors.
2) Eligibility
You must be 18 years or older and legally competent to enter into a binding contract under Indian law.
You confirm that any information you provide is accurate and complete.
3) Accounts & Security
You may need to create an account to place orders or manage subscriptions. Keep your login details confidential.
You are responsible for all activity under your account. Notify us of unauthorized use immediately.
We reserve the right to suspend or terminate your account for policy breaches, fraud, or legal risks.
4) Acceptable Use
You agree not to:
Post or transmit unlawful, harmful, obscene, defamatory, or misleading content;
Impersonate others, upload malware, or attempt to breach website security;
Copy, scrape, deep-link, reverse engineer, or commercially exploit website content without written consent;
Violate any applicable laws (IT Act, Consumer Protection Act, Food Safety Act, etc.).
We may monitor, remove, or restrict content or access to protect users and ensure compliance with law.
5) Orders, Pricing, Payments & Taxes
Orders: When you place an order, you are making an offer to the Chef. Acceptance depends on availability and drop-off serviceability.
Prices: Prices are set by Chefs (or by Pick My Chef for curated menus) and may change. They may include packaging or handling fees.
Payments: All payments are processed securely through authorized gateways (e.g., UPI, card, or net banking). We act as a limited collection agent for Chefs or Drop-off Partners to collect payment on their behalf.
Taxes: Applicable taxes are levied as per law and shown in your invoice.
Invoices: Tax invoices (if applicable) are issued by the Chef or Drop-off Partner.
Currency: All transactions are processed in INR (Indian Rupees).
In case of typographical or system pricing errors, we reserve the right to cancel or adjust the order and will notify you promptly.
6) Drop-off Policy
Drop-off times are estimates and may vary based on traffic, weather, and order volume.
Please ensure accurate address and access details. Failure to receive the meal at the scheduled time may result in cancellation without refund.
Once the food is dropped off to the specified address or authorized recipient, risk transfers to the customer.
If there’s an issue with your meal, contact our support team immediately — we’ll coordinate with the Chef or Drop-off Partner to resolve it promptly.
7) Refund & Replacement Policy
Damage:
Once damaged order is returned and approved then the order will be dropped off on the same day.
Replacement & Exchange:
If replacement is approved, then exchanged or replaced product will be dropped off the same day.
Replacement request should be made on the same day after receiving the product.
Refund Policy:
Refund is not applicable once payment is done.
Shipping Policy:
All orders will be dropped off within the scheduled time
8) Subscription Plans
We offer weekly and monthly meal subscription plans in select drop-off zones.
Rescheduling or skipping meals is subject to plan-specific cut-off times and operational availability.
Unused meals typically cannot be carried forward unless otherwise stated.
10) Credits & Loyalty (“Pick Points”)
From time to time, we may issue Pick Points or promotional credits for offers or rewards.
Credits are non-cash, non-transferable, and may expire.
Misuse or fraudulent activity may result in credit cancellation or account suspension.
11) Quality, Hygiene & Allergen Disclaimer
Chefs are fully responsible for food preparation, hygiene, FSSAI compliance, and allergen disclosure.
Since food is prepared in home kitchens, we cannot guarantee the absence of allergens or cross-contamination.
Customers with allergies should contact support before ordering.
12) Third-Party Links
The Website may contain links to external websites or third-party services. We are not responsible for their privacy practices, accuracy, or content.
13) Intellectual Property
All content, layout, and designs on the Website are owned by or licensed to Pick My Chef Private Limited.
“Pick My Chef” and related logos are trademarks of the Company.
You may not copy, reuse, or distribute any content without written authorization.
14) User Feedback
By submitting feedback, reviews, or testimonials, you grant Pick My Chef a royalty-free, perpetual license to use, reproduce, and display them for promotional and operational purposes.
We may remove inappropriate, defamatory, or misleading reviews at our discretion.
15) IP Notice & Takedown Policy
If you believe your intellectual property has been infringed on www.pickmychef.com, please email brand-protection@pickmychef.com with:
Contact details and proof of ownership;
Specific URLs/screenshots;
A signed good-faith declaration.
We may remove content during investigation and inform the affected parties.
16) Disclaimers
The Website and its Services are provided “as is” and “as available.”
We do not guarantee uninterrupted or error-free service, nor the accuracy of menu listings, availability, or drop-off times.
We do not warrant the quality, taste, or fitness of meals prepared by independent Chefs.
17) Limitation of Liability
To the maximum extent permitted by law, Pick My Chef will not be liable for any:
Indirect, incidental, or consequential damages;
Loss of profits, goodwill, or data;
Delays or failures caused by Chefs, Drop-off Partners, or external factors.
If liability arises, our total liability will not exceed the value of your last paid order.
18) Indemnity
You agree to indemnify and hold Pick My Chef, its affiliates, and employees harmless against any claims, losses, or expenses arising from:
Violation of these Terms or laws;
Misuse of the Website;
Infringement of third-party rights.
19) Communication & Consent
By using the Website, you consent to receive transactional and promotional messages via email, SMS, or WhatsApp.
You can opt out of marketing communication anytime (transactional messages will continue).
20) Suspension or Termination
We may suspend or terminate access to the Website for misuse, fraud, or policy violations.
Termination ends your access immediately, but obligations accrued before termination remain enforceable.
21) Governing Law & Jurisdiction
These Terms are governed by the laws of India.
All disputes are subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana.
22) Severability
If any provision is found unenforceable, the remainder of the Terms shall remain valid and enforceable.
23) Updates to Terms
We may revise these Terms periodically. Updated versions will be posted on www.pickmychef.com with a new “Last Updated” date. Continued use implies acceptance.
